IMPORTANT - PLEASE READ CAREFULLY. This End User License Agreement (“Agreement”) is a legally binding agreement between you, whether an individual or an organisation (“User” or “You”), and TreeTalk (“TreeTalk”, “We”, “Us”, or “Licensor”) governing your use of TreeTalk Node software and applications. By downloading, installing, copying, accessing, purchasing, or using the Software, You acknowledge that You have read, understood, and agree to this Agreement and the TreeTalk Privacy Policy. If You do not agree, do not install or use the Software.
“Software” means the TreeTalk Node applications, executable files, packages, updates, documentation, and related components made available by TreeTalk through authorised channels.
Package names are permanent once reserved in Google Play. If a different package name is used in the published build, the published package and store listing control.
Subject to this Agreement, TreeTalk grants You a revocable, non-exclusive, non-transferable, limited licence to install and use the applicable Free Edition on devices that You own or control, or that You are authorised to use. The Free Edition may be used for personal, professional, educational, or internal business purposes, subject to its technical limits and applicable law.
Subject to payment and the licence terms shown at purchase, TreeTalk grants You a revocable, non-exclusive, non-transferable licence to install and activate the paid Windows edition on the permitted number of devices. Unless an Enterprise or other written agreement states otherwise, a device-specific licence may be limited to one Windows PC at a time.
Subject to a valid Google Play purchase, TreeTalk grants You a revocable, non-exclusive, non-transferable licence to install and use TreeTalk Node Pro on devices permitted by Google Play and Your Google account. Google Play purchase, installation, refund, and device-entitlement rules also apply. A Windows licence does not activate Android Pro, and an Android Pro purchase does not activate a paid Windows edition, unless TreeTalk expressly states otherwise in writing.
Enterprise deployment, mass installation, volume licensing, managed support, and additional rights are governed by the applicable written Enterprise agreement. If that agreement conflicts with this Agreement, the Enterprise agreement controls for the licensed deployment.
The Windows Portable / Direct-Download edition ordinarily provides a 14-day Premium evaluation. The Windows Microsoft Store edition ordinarily provides a 7-day Premium evaluation. No payment card or registration is required merely to begin the evaluation unless the store listing or purchase flow expressly says otherwise. When the evaluation ends, the Windows app continues under the Free limits then displayed in the app and product documentation.
The Android Free Edition ordinarily provides a 7-day, per-installation evaluation of selected Pro functions. During that period:
Each allowance ends when the relevant quantity is exhausted or when the 7-day period expires, whichever occurs first. A cancelled voice recording should not consume the voice allowance. A file should count when it is accepted for sending through the multi-file workflow, not merely viewed in the system picker.
After the evaluation ends, the Android Free Edition remains usable with permanent Free limits that currently include a maximum of 3 active peers and a maximum individual file size of 100 MB. Voice-message sending and multi-file sending are disabled after their evaluation allowance or time period ends. Ordinary single-file sending and other Free functions remain available.
Evaluation dates and counters may be stored locally. Clearing app storage, uninstalling and reinstalling, restoring a backup, or migrating to another device may affect the local evaluation state. TreeTalk does not guarantee that an evaluation can or cannot be repeated after those actions. You must not use automated, deceptive, or technically abusive methods to circumvent licence or evaluation controls.
Expiration of an evaluation or transition to Free limits does not intentionally delete messages, received files, or voice recordings already stored on the device. Content remains in the applicable folder or app storage until deleted by the user, device administrator, operating system, or storage-management process.
TreeTalk Node for Android and TreeTalk Node Pro for Android use different package names and are treated by Android and Google Play as separate installations. Purchasing or installing Pro does not automatically convert, replace, uninstall, or unlock the Free Edition.
Settings, message history, encryption configuration, and private app data do not automatically move between the two apps unless TreeTalk provides an explicit export/import or migration function and the user authorises it. Files stored in a shared or user-selected folder may remain accessible independently of either installation.
Users should verify that Pro has been installed and any desired settings have been transferred before removing the Free Edition.
The Software may be made available through TreeTalk websites, Microsoft Store, Google Play, or another authorised channel. Store operators may impose additional terms governing acquisition, installation, updates, device limits, payment, refund, taxation, and availability.
Permission to redistribute an original, unmodified TreeTalk package applies only where TreeTalk expressly permits redistribution. It does not authorise extraction, repackaging, sideload distribution, resale, or redistribution of an Android App Bundle, APK, Microsoft Store package, licence key, or paid edition.
For Android, purchases of TreeTalk Node Pro must be completed through Google Play when obtained from Google Play. The Free Edition may include a non-intrusive link or notice directing the user to the separate Pro listing on Google Play.
IMPORTANT SECURITY NOTICE. The Software may configure default settings to allow immediate evaluation, including a default encryption passphrase or default receiving folder. A default or publicly known passphrase is not unique to Your installation and must not be treated as adequate protection for confidential, personal, regulated, or commercially sensitive data.
Before sending sensitive information, You should:
TreeTalk cannot recover a forgotten passphrase unless the Software expressly provides a recovery mechanism. Encryption does not protect data on a compromised endpoint, after decryption, or where a passphrase is weak, reused, disclosed, or left at its default value.
The Android apps may request permissions or user authorisation needed for core functions, including recording a voice message, showing notifications, selecting a file or folder, maintaining a user-initiated transfer, and communicating with devices on the local network. You may deny optional permissions, but the related function may be unavailable.
The Software should access the microphone only when the user initiates voice recording and should access only files or folders selected or authorised by the user. Local peer-discovery data may be visible to other reachable TreeTalk Node devices on the same network or VPN.
The Software is licensed, not sold. TreeTalk and its licensors retain all rights, title, and interest in the proprietary Software, documentation, branding, interfaces, and intellectual property.
The Android apps include open-source components licensed under their applicable licences, including Apache-2.0, MIT, and dual MIT/Apache-2.0 licences. Those component licences govern the relevant open-source code and may grant rights in addition to this Agreement. This Agreement does not restrict rights that cannot lawfully be restricted under an applicable open-source licence.
TreeTalk’s first-party cryptographic core uses AES-256-CTR, HMAC-SHA-256, and PBKDF2. The presence of security functions does not create a warranty that every configuration, endpoint, network, or passphrase is secure.
Except to the extent a restriction is prohibited by mandatory law or an applicable open-source licence, You must not:
You control the messages, files, voice recordings, peers, networks, folders, and passphrases used with the Software. You are responsible for having authority to send and process that content and for selecting the correct recipient.
The Software does not provide TreeTalk with routine access to local communications. TreeTalk does not pre-screen or approve content exchanged between users. A receiving user may block or ignore a peer where the app provides that function and may report unlawful or abusive conduct to TreeTalk or the appropriate authority. Blocking a peer does not delete copies already delivered.
Files received from another device may be malicious, unwanted, or mislabelled. Verify the sender, use current endpoint protection, and inspect files before opening them.
The TreeTalk Privacy Policy is incorporated into this Agreement by reference and explains how TreeTalk handles website, licensing, support, store, and diagnostic information. Ordinary files, messages, and voice recordings are designed to move directly between devices rather than through TreeTalk servers.
You are responsible for any notices, consents, contracts, or organisational policies required for Your use of the Software, including where employee, customer, patient, student, or other third-party data is transmitted.
TreeTalk may provide updates, patches, security fixes, and feature changes through the applicable distribution channel. You are responsible for installing critical updates promptly. Store-distributed editions may update automatically according to store and device settings.
TreeTalk does not guarantee that updates, support, compatibility, a particular feature, or an evaluation offer will be available indefinitely.
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. TREETALK DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, TITLE, AND NON-INFRINGEMENT WHERE SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.
TreeTalk does not warrant uninterrupted or error-free operation, compatibility with every device or network, recovery of transferred content, or prevention of unauthorised access in every configuration.
Nothing in this Agreement excludes or limits mandatory consumer rights, statutory conformity remedies, liability for fraud, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence, or any other liability that applicable law does not permit TreeTalk to exclude or limit.
To the maximum extent permitted by applicable law, TreeTalk and its directors, employees, agents, affiliates, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, profit, revenue, goodwill, business opportunity, or business interruption, arising from use of or inability to use the Software.
Where liability may lawfully be limited, TreeTalk’s aggregate liability for claims relating to a paid edition will not exceed the amount paid for the affected licence or app during the 12 months preceding the event giving rise to the claim. For a Free Edition, aggregate liability will not exceed EUR 10. These limits do not apply where prohibited by mandatory law.
To the extent permitted by law and, for consumers, only where such an obligation is valid and proportionate, You agree to indemnify TreeTalk against third-party claims arising from Your unlawful use of the Software, content You transmit without authority, infringement of third-party rights, deliberate circumvention of security or licence controls, or material breach of this Agreement.
The Software includes encryption and may be subject to export-control, sanctions, and import laws of Italy, the European Union, the United States, and other jurisdictions. You must not export, re-export, transfer, or use the Software in violation of applicable restrictions.
This Agreement begins when You first download, install, purchase, or use the Software and continues until terminated.
You may terminate by uninstalling the Software and ceasing use. TreeTalk may terminate or suspend a licence for a material breach, fraudulent purchase, unlawful use, or deliberate circumvention of licence controls, subject to mandatory consumer law and applicable store procedures.
On termination, the licence ends and You must stop using and remove the affected Software. Provisions concerning ownership, restrictions, privacy, user content, disclaimers, liability, indemnification, export control, governing law, and general terms survive as necessary.
This Agreement is governed by the laws of the Republic of Italy, without regard to conflict-of-law rules, except where mandatory consumer law of the User’s country applies.
The parties should first attempt in good faith to resolve a dispute through written notice and 30 days of negotiation. Subject to mandatory consumer-jurisdiction rules, the courts of Rome have exclusive jurisdiction. A consumer may bring proceedings in the courts of the consumer’s domicile where applicable law grants that right.
